Wrongful Death Lawyer

The loss of a loved one is devastating, especially if the death was caused by another's person's negligent or reckless behavior.

A wrongful death lawyer can help you recover compensation for financial and emotional losses by filing a wrongful death claim.

At Quick Law Group, PLLC, in Bellevue, WA, our lawyers can help you hold the responsible party accountable to ease your financial burden.

Who Can File a Wrongful Death Lawsuit in Washington?

If your loved one suffered a premature death due to another person or party's negligence, you may be wondering if you have the legal right to file a wrongful death lawsuit. We always encourage people in this situation to reach out to our law firm to discuss your case with our lawyers.

In Washington, the following people are eligible to file wrongful death claims on behalf of the deceased:

The Personal Representative of the Estate

If the deceased had a will and an executor or personal representative appointed, that person can file a wrongful death claim on behalf of the estate. However, there are many cases in which victims don't have a will or personal representative. In these cases, eligible relatives can file a claim.

Eligible Relatives

The spouse, registered domestic partner, children, or stepchildren have priority when filing a wrongful death lawsuit. If there are no surviving relatives in these four categories, then parents or siblings may be eligible beneficiaries of a positive wrongful death settlement or verdict.

Parents of Minor Children

If a person under the age of 18 suffers a wrongful death, the parents have the legal right to file a wrongful death lawsuit. If the parents are separated or divorced, or if they were never married, they may file individual claims.

Five stars is not enough. I contacted the Quick Law Group after my first lawyer failed several times to respond to my inquiries. From the first day we spoke, until the case was completed, the lawyers at this firm were very responsive, sympathetic and extremely professional. In addition to keeping me well informed, they explained all of the legal and medical issues in plain English. I also know for a fact they spent many hours dealing with many people who were "less than cooperative."
I am in my sixties and have dealt with the many members of the legal profession throughout my adult life. I can say without question, should the need arise you will be smart to read about the others, and then hire the Quick Law Group!

My wife had PTSD after a really bad crash. She hated dealing with anything related to her crash because it added onto her anxiety. Another attorney she had spoken to said she would have to do this or that, thus leading to more anxiety, whereas Matt Quick took care of everything, thus putting her at ease. It was also very important for my wife to hire someone whom is honest and fair, while looking out for his or her client's best interest. She didn't want to hire the next attorney who plans on milking the insurance company. She wanted someone honest. Matt was just that guy. He was also very thorough and communicated everything very well. It was such a relief for my wife to have someone she could trust handle everything for her.

Causes of Wrongful Death

The statistics listed in the section below were reported in the National Highway Traffic Safety Administration's Washington State 2018 Traffic Safety Annual Report. The following causes of wrongful death don't constitute a complete list of accidents that can lead to these tragic events. These are some of the most common causes of wrongful death that our attorneys have seen at our Bellevue practice.

Car Accidents

The state had 536 auto accident fatalities in 2016 and 565 auto accident fatalities in 2017. These statistics highlight the dangers of car accidents. Sadly, in many cases, car accidents are caused by distracted driving, speeding, driving under the influence, and other reckless behaviors that can result in the wrongful death of a loved one.

Car Accidents

Truck Accidents

The state had 52 accident fatalities involving heavy trucks in 2016 and 83 accident fatalities involving heavy trucks in 2017. Potential causes of commercial truck accidents include driver fatigue, driving under the influence, poor driver training, improper truck maintenance, and a range of other factors. Our wrongful death attorneys in Bellevue will investigate the circumstances of each case to determine if the truck driver or company acted negligently and contributed to your family member's premature death.

Truck Accidents

Motorcycle Accidents

Washington had 81 motorcycle accident fatalities in 2016 and 77 motorcycle accident fatalities in 2017. Motorcycle accidents may be caused by poor road conditions, road obstructions, sudden stops, improper turns, and defective products. Liability for these accidents may fall on the local jurisdiction, other drivers, or the manufacturers of defective products. Our Bellevue attorneys will investigate.

Motorcycle Accidents

Pedestrian Accidents

There were 88 pedestrian accident fatalities in the state in 2016 and 109 pedestrian accident fatalities in 2017. Pedestrians always have the right of way, so these cases can seem pretty clear cut. However, it is always helpful to have a wrongful death lawyer that can investigate all of the circumstances of the case. If the driver of the vehicle was speeding, distracted, or otherwise acting negligently, you may have a strong wrongful death case.

Pedestrian Accidents

Construction Accidents

Construction sites can be dangerous, particularly when construction companies fail to comply with OSHA safety standards. Falls from cranes, ladders, scaffolding, and other heights can result in death. Crush injuries due to the use of heavy equipment, electrocutions, exposure to toxic materials, and other accidents can result in premature death. Our wrongful death attorneys will determine if a construction company, third-party contractor, or another person was liable for the accident.

Wrongful Death Statutes of Limitations in Washington

The Importance of Filing Quickly

We recommend getting in touch with our wrongful death lawyers soon so we can begin investigating your wrongful death claim as early as possible. It can be more difficult to find and establish strong evidence months or years after the event occurred. Witness memories may fade, documents may be harder to access, and evidence may be lost.

In Washington, wrongful death lawsuits must be filed within three years of the victim's death.

Technicalities that Affect Time Limits

There are some technicalities that may extend or limit the statutes of limitations. If the negligence that caused the death wasn't discovered until a later date, the time limit may be extended based on the discovery rule. On the other hand, if a previous personal injury results in death years later, the statute of limitations may have run out. Talk to our wrongful death lawyers about the circumstances of your case so we can advise you on how to proceed.

Damages in Wrongful Death Cases

Loved ones can seek economic and non-economic damages, including punitive damages, in wrongful death cases. Our wrongful death lawyers in Bellevue will seek full compensation for:

Medical expenses

Funeral and burial costs

Loss of income due to the family member's death

Loss of support

Loss of consortium

Loss of services

Pain and suffering

Loss of prospective inheritances

Property damage
