In Washington, the following people are eligible to file wrongful death claims on behalf of the deceased:

The Personal Representative of the Estate

If the deceased had a will and an executor or personal representative appointed, that person can file a wrongful death claim on behalf of the estate. However, there are many cases in which victims don't have a will or personal representative. In these cases, eligible relatives can file a claim.

Eligible Relatives

The spouse, registered domestic partner, children, or stepchildren have priority when filing a wrongful death lawsuit. If there are no surviving relatives in these four categories, then parents or siblings may be eligible beneficiaries of a positive wrongful death settlement or verdict.

Parents of Minor Children

If a person under the age of 18 suffers a wrongful death, the parents have the legal right to file a wrongful death lawsuit. If the parents are separated or divorced, or if they were never married, they may file individual claims.
