The Personal Representative of the Estate

If the decedent had a will and an appointed executor or personal representative, that person can file a wrongful death claim on behalf of the estate. However, there are many cases in which victims don't have a will or personal representative. In these cases, eligible relatives can file a claim.

Eligible Relatives

The spouse, registered domestic partner, children, or stepchildren of the decedent have priority when filing a wrongful death lawsuit. If there are no surviving relatives in these four categories, then parents or siblings may be eligible beneficiaries of a positive wrongful death settlement or verdict.

Parents of Minor Children

If a person under the age of 18 suffers a wrongful death, the parents have the legal right to file a wrongful death lawsuit. If the parents are separated or divorced, or if they were never married, they may file individual claims.

Brad Fulton is the best. Met me in my home. Negotiated and guided me through everything after a really bad head on with a drunk. I dont think he sleeps. Really cares and cares more about clients than money. I recommend him to anyone that will listen.

Liz Quick is a brilliant trial attorney. I was the plaintiff in my case and I remember sitting in that courtroom thinking “She is incredible!” She operated with such ease and such confidence in what she was doing that I just couldn’t be anything less than in total awe of her. She also was amazingly pleasant to just be around. When you are feeling as vulnerable as I felt during during the trial, having someone on your side like Liz meant so much.

My husband and I worked with Matt after his motor vehicle accident. He was patient with my husband as he grappled to understand his injuries as well as the legal system without previous accidents and with Spanish as his primary language. Medical bills and a long term plan were initially overwhelming but taking it one step at a time and checking in regularly allowed for a helpful and safe outcome in every way.

Wrongful Death Statute of Limitations In the State of Washington

The Importance of Filing Quickly

In Washington, wrongful death lawsuits must be filed within three years of the victim's death. We recommend getting in touch with our wrongful death lawyers as soon as possible so we can begin investigating your wrongful death claim. It can be more difficult to find and establish strong evidence months or years after the event occurred. Witness memories may fade, documents may be harder to access, and evidence may be lost.

In Washington, wrongful death lawsuits must be filed within three years of the victim's death.

Technicalities That Affect Time Limits

There are some technicalities that may extend or limit the statute of limitations. If the negligence that caused the death wasn't discovered until a later date, the time limit may be extended based on the discovery rule. On the other hand, if a previous personal injury results in death years later, the statute of limitations may have run out. Talk to our wrongful death lawyers about the circumstances of your case so we can advise you on how to proceed.

Causes of Wrongful Death

The statistics listed below were reported in the Washington State 2022 Traffic Safety Annual Report and 2020 Traffic Safety Facts Data Sheet published by the National Highway Traffic Safety Administration, as well as the 2022 Medical Malpractice Annual Report published by the Washington State Office of the Insurance Commissioner. The following causes of wrongful death don't constitute a complete list of accidents that can lead to these tragic events. They are, rather, some of the most common causes of wrongful death that the attorneys at our Bellevue practice have seen.

Car Accidents

Our state had 670 traffic accident fatalities in 2021. This number was approximately 100 deaths higher than any of the previous five years. These statistics highlight the dangers of car accidents. Sadly, in many cases, car accidents are caused by distracted driving, speeding, driving under the influence, and other reckless behaviors that can result in the wrongful death of a loved one.

Truck Accidents

Our state had a total of 60 accident fatalities involving large trucks in 2020. Potential causes of commercial truck accidents include driver fatigue, driving under the influence, poor driver training, and improper truck maintenance. Our wrongful death attorneys in Bellevue will investigate the circumstances of each case to determine if the truck driver or company acted negligently and contributed to your family member's premature death.

Motorcycle Accidents

Washington had 93 motorcycle accident fatalities in 2020 and 93 again in 2021. Motorcycle accidents may be caused by poor road conditions, road obstructions, sudden stops, improper turns, or defective products, among other reasons. Liability for these accidents may fall on the local jurisdiction, other drivers, or the manufacturers of defective products. Our Bellevue attorneys will investigate.

Pedestrian Accidents

There were 110 pedestrian accident fatalities in the state in 2020 and 145 pedestrian accident fatalities in 2021. Pedestrians always have the right of way, so these cases can seem clear-cut. However, it is always helpful to have a wrongful death lawyer who can investigate all of the circumstances of the case. If the driver of the vehicle was speeding, distracted, or otherwise acting negligently, you may have a strong wrongful death case.

Construction Accidents

Construction sites can be dangerous, particularly when construction companies fail to comply with OSHA safety standards. Falls from cranes, ladders, scaffolding, and other heights can result in death. Crush injuries due to the use of heavy equipment, electrocutions, exposure to toxic materials, and other accidents can result in premature death. Our wrongful death attorneys will determine if a construction company, third-party contractor, or another person was liable for the accident.

Medical Malpractice

Over a 5-year period ending on December 31, 2021, Washington State reported 622 wrongful death medical malpractice claims. Medical professionals must provide a reasonable standard of care. Failing to do so makes them liable in a medical malpractice claim. Examples of medical malpractice resulting in wrongful death include delaying necessary treatment, premature patient release, failure to diagnose, and failure to diagnose pre-existing conditions.

Don't Speak With Insurance Companies Let Us Handle All Communication

Insurance company representatives often reach out to grieving families. They frequently offer lowball settlements that may seem like a lot in the moment but do not actually quantify your losses.

Do not give them any details about your wrongful death case and do not give any personal details or other contact information. Take note of what they say to you and allow our Bellevue law firm to handle all communication.
